3a. Creator Responsibility for Your Audience's Data
Creattur provides tools that allow you, as a creator, to collect information from your own audience — including email subscribers, booking customers, and digital product purchasers. When you use these features, you become the data controller for the personal information your audience provides to you, and Creattur acts only as a data processor on your behalf.
As the data controller, you are solely responsible for:
- Complying with all applicable privacy and data protection laws in your jurisdiction and the jurisdictions of your audience, including but not limited to GDPR, CCPA, and CAN-SPAM
- Having a lawful basis for collecting and using your audience's personal information
- Providing your audience with adequate notice about how their data will be used
- Honoring any opt-out, deletion, or access requests from your audience members
- Ensuring that any use of your audience's data complies with your own privacy policy
Creattur does not access, use, or share the personal information your audience provides to you except as necessary to deliver the features you have enabled (e.g., storing email subscribers in your list, processing a booking). You agree to indemnify Creattur for any claims arising from your failure to comply with applicable data protection obligations as described in our Terms of Service.
4. Sharing Your Information
We do not sell your personal information to third parties.
We may share your information with:
- Payment processors: Stripe, Inc. processes all payment transactions. Stripe's use of your payment data is governed by the Stripe Privacy Policy.
- Analytics providers: We may use tools such as Google Analytics to understand how the Service is used. These providers may set their own cookies.
- Email delivery services: We use providers such as SendGrid and Mailgun to deliver transactional and marketing emails on our behalf.
- Cloud infrastructure: We use Amazon Web Services (AWS) for storage and hosting of user-uploaded content.
- Legal and safety: We may disclose information to law enforcement, regulators, or other authorities where required by applicable law, court order, or to protect the rights, property, or safety of Creattur, our users, or others.
- Business transfers: In the event of a merger, acquisition, or sale of all or substantially all of our assets, your information may be transferred to the acquiring entity, subject to the same privacy protections.
All third-party service providers are contractually required to use your information only as necessary to provide services to us and in accordance with applicable law.
5. Data Retention
We retain your personal information for as long as your account is active or as needed to provide the Service. Specifically:
- Active accounts: We retain account data for the duration of your account
- Closed accounts: We delete or anonymize personal data within 90 days of account closure, except where we are required to retain it for legal, tax, or audit purposes (typically up to 7 years for financial records)
- Uploaded content: Files and digital products are deleted within 30 days of account closure unless subject to a pending dispute or legal hold
- Analytics data: Aggregated, non-identifiable analytics data may be retained indefinitely
You may request deletion of your data at any time as described in Section 7.
6. Data Storage and Security
We implement industry-standard technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include:
- Encryption of data in transit (TLS) and at rest
- Access controls limiting data access to authorized personnel
- Regular security assessments and monitoring
- Secure third-party infrastructure (AWS, Neon PostgreSQL) with compliance certifications
No method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security. If you believe your account has been compromised, please contact us immediately at support@creattur.com.

10. Marketing Communications
